By downloading, installing, or using the Secret application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Hengtong Li ("we," "us," or "our"), the developer of the Secret app (Bundle ID: com.lastember.Secret).
Secret is a mindfulness and observation application that provides users with a daily "Secret" -- a prompt encouraging you to notice something beautiful in everyday life. The App offers:
The App uses Firebase Anonymous Authentication by default. No registration, email, or personal information is required to use the core features of the App. An anonymous identifier is automatically assigned to your device.
You may optionally sign in with your Apple ID to enable cross-device data synchronization and backup. By linking your Apple ID, you agree to Apple's terms and conditions in addition to these Terms. You are responsible for maintaining the security of your Apple ID credentials.
You are responsible for all activity that occurs under your anonymous identifier or linked Apple ID. If you believe your account has been compromised, please contact us immediately.
All content provided through the App, including but not limited to daily Secrets (prompts), text, graphics, logos, icons, images, user interface design, and software, is the intellectual property of Hengtong Li and is protected by applicable copyright, trademark, and other intellectual property laws.
The daily Secret prompts are original copyrighted works. You may not reproduce, distribute, publicly display, create derivative works from, or commercially exploit these prompts without our prior written consent.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:
Any feedback, suggestions, or ideas you provide about the App may be used by us without obligation or compensation to you.
The App allows you to submit optional "echo" text (up to 280 characters) as a reflection on daily Secrets. By submitting echo text, you:

The App offers a voluntary tip jar with consumable in-app purchases at the following price points:
Tips are voluntary contributions to support the continued development of Secret. They do not unlock additional features or content. The App has no subscriptions.
All in-app purchases are processed by Apple through the App Store. We do not collect, store, or process any payment information. All transactions are subject to Apple's terms and conditions.
Tips are consumable purchases and are non-refundable through the developer. If you wish to request a refund, you must do so through Apple's standard refund process at reportaproblem.apple.com. Refund decisions are at Apple's sole discretion.
You agree to use the App only for its intended purpose and in compliance with all applicable laws. You shall not:
We strive to maintain continuous availability of the App but do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

The daily Secrets are creative prompts for mindfulness purposes only. They do not constitute professional advice of any kind (medical, psychological, or otherwise).
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LASTEMBER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL.
In no event shall our total aggregate liability arising out of or in connection with the App or these Terms exceed the amount you have paid to us through in-app purchases in the twelve (12) months preceding the claim, or fifty US dollars ($50.00 USD), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Hengtong Li from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:
You may stop using the App at any time by deleting it from your device. You may request deletion of your data by contacting us at hengtong.li@foxmail.com.
We reserve the right to suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the App ceases immediately.
Upon termination, all licenses granted to you under these Terms shall immediately cease. Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hengtong Li is domiciled, without regard to its conflict of law provisions. Where mandatory consumer protection laws apply in your jurisdiction, those laws shall prevail to the extent they cannot be contractually overridden.
Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of competent jurisdiction.
Nothing in these Terms affects your statutory rights as a consumer under applicable law. If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
The following additional terms apply to your use of the App as downloaded from the Apple App Store:
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Hengtong Li regarding the App.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the revised Terms.
